YouTube in a lot of ways is becoming the center of the Universe to market independent music. If you don’t have a YouTube Channel, then you are setting yourself up to enter the fighting ring with one hand tied behind your back. That being said, the ultimate goal is to use social media sites as road post pointing Fans to your own website. This is the most critical aspect in marketing your music. You must invest the time, money and effort into developing, launching and maintaining your own website as the hub for your everything that you do and everything that you are attempting to sell.

Go into 2012 seeing yourself as a STORE and not just as a artist/musician/songwriter!!!

Read this article!!! It will motivate you!!!

The thing I love about Mac is that he gets it. He understands that it is better to get a bigger slice of a smaller pie, than almost no slice at all from a huge pie. When you do the numbers, dollars wins over pennies. But what artists/musical groups/bands get caught up into thinking is that having the major label machine behind them will translate into them making more money. It sounds good, but in most cases it is not true. Now I grant you, if you are signed to a major label you may be able to charge a higher fee for your shows, but those days are rapidly coming to an end. Nowadays, you can’t draw people to a show just because you are an artist signed to a major label, instead people attending live shows are there because somehow they feel connected with that particular artist whether or not that artist is signed to a major label.

It boils down to your efforts to consistently connect your music to a fanbase that is loyal to you as opposed to being loyal to the record label you may happened to be signed to. We have a post called Rent-A-Fanbase versus Own-A-Fanbase that goes into this topic much deeper and we highly recommend you to read.

Find a way to get your music and products into your fans’ hearts and that will get you to the money. It is not easy….but it can happen…just read Mac Miller’s story!!!

OFF D GRID is a movement we are still pushing. The Heretic’s Comment: Those of you who read this blog regularly know how strongly we emphasize the importance of owning and controlling your creative content, but with that being said, there is something fundamentally wrong with the way the U.S. Congress is attempting to enforce the rights of content owners through the proposed controversial legislation known as SOPA (Stop Online Piracy Act).

The major entertainment conglomerates from the music, books and film industries among others are all lining up to put pressure on Congress to pass this legislation which would effectively criminalize the act of posting up content which you can’t prove that you have ownership in or  license to use.

One version of the act, has as part of its punishment, a 5 year prison sentence for a first time offender. Additionally, websites such as YouTube or Facebook which allows users to place content on their sites could be shut down (yanked from the internet) if the offending content is not removed within 5 days of posting.

The Entertainment Conglomerates are using SOPA as another way to control and police content. Either you play their game or they shut you down and possibly have prosecutors attempt to throw you in jail. These companies have not learned one damn thing. They tried this same tactic when the RIAA (Record Label Police) went after highschoolers and college kids among others for file sharing. These efforts had a negative impact on the public’s view of the major labels which still lingers to this very day.

We have told you several times in this blog that censorship of the internet is the fight taking place as we speak, but sadly most of the public is not even aware that a war is being waged.

In the case of Conglomerates who are in the business of  buying content, stop giving up your ownership to these companies. Once they own your content and a law like SOPA is passed, you could possibly be thrown in jail for posting up your own music to YouTube!!! Stop this madness!!!

The Heretic’s Comment: The issue revolving around how recording artist should be paid from digital downloads continues to be fought out in court. In 2010 Eminem was able to win a lawsuit against Universal Music Group for how it was calculating the royalties payable to him for digital downloads (please search for our earlier post which discussed the Eminem lawsuit). And now a few weeks ago, a California Federal Judge gave initial approval for allowing a class action lawsuit to move forward against Universal Music for the same issue that was the basis of the Eminem lawsuit.

As a brief review, the essential issue that recording artists are hopping mad about revolves around Universal Music’s “fuzzy logic” in arguing that digital downloads operate as a sale and not as a licensing event.

Why does Universal Music want digital downloads to be classified as a sale and not a license, because their recording contract will allow them to pay the artist the standard artist rate (10 to 20 percent of retail) (in other words pennies on the dollar).

On the other hand, why do recording artist want digital downloads to be treated as a license, because recording contracts normally require that granting a license to a recording requires the Record Label and the artist to split the licensing fees 50/50.

So we are talking about a significant difference in the amount of money the artist can make per digital download sold based on whether the digital download is classified as a sale versus a license.

Closing Comments:

If you are already selling product independently and a record label offers to sign you to a recording agreement, look at the way the record label is attempting to calculate your payments for product sold. Remember, most artist who sign with major record labels never see one dime of artist royalties, so make sure that if you are able to sell enough units to pay for your recording fund that you have maximized the money you will make per unit sold.

Your best defense against the above, is to try and get the record label to pay you the biggest advance possible upfront. Unfortunately, however, advances are not what they use to be…but if you sign a recording agreement and don’t get any money up front, you are setting yourself up for the victim scenario!!!

An example of Music CD Cost and Payout Breakdown

According to Moses Avalon’s 1998 Book, Confessions of a Record
Producer, the proceeds of a then-$17 CD would typically be distributed
as follows:

Retailer: $5 (29.4%),
Record label: $4.92 (28.9%),
Distributor: $2.40 (14.1%),
Giveaways: $1.80 (10.6%),
Duplication/recording: $1.10 (5.8%),
Artist royalty: 83 cents (4.9%),
Songwriter license: 60 cents (3.5%),
Producer royalty: 27 cents (1.6%),
Musicians union: 8 cents (0.4%).

Now mind you, the numbers used in our example are from years ago, but it is instructive to show you just how greedy and abusive the Major Labels have been both to recording artists/producers/songwriters as well as to the general consumer.  The physical production cost of each CD might have cost the Major Label anywhere from 6 cents to 50 cents to manufacture, yet the Labels had the price jacked up in some cases as high as $19.98 for the retail price of the CD. Of this retail pricing, the combined money paid out to the recording artist, songwriter, producer and musician was  less than $2.00 per CD sold (in our example, it was actually $1.74 per CD sold).

The saddest part about the above is that despite using numbers from over 10 years ago, nothing presently has changed in the artist’s favor in reference to those signed under major recording contracts. In fact,  it is even worst now,  because of all of the 360 arrangements that Major Labels force artists to eat in exchange for getting a deal. So the possibility of an artist making money through record royalties in 2011 remains almost non-existent despite the fact that in this year Major Record Labels and their partners will pocket millions upon millions of dollars from physical CD sales.

Sadly enough the numbers on the digital side are even worst than the physical side, but we will deal with that in a separate post.

Closing Comments:

You have to have the courage to speak to Power and refuse to bow down. That is the only way these slave deals will ever change. As long as we are fighting and competing against each other to see who will have the next opportunity to be offered the major label deal, 10 years from now…nothing will have changed. Your musical sons and daughters will be signing the same slave deal you were forced to sign. Even more sadder than that is the fact that you will own none of your music…it will be under the firm control and ownership of a Conglomerate that has long forgotten about you.

The Heretic’s Comments: Black Friday has been purposefully marketed and developed to be a financial juggernaut for Big Box retailers and Conglomerate owned retail stores.

However, the independent Creative Community wants to make money on Black Friday and Cyber Monday to.

I was unable to get this post out earlier, but to those of you who are out make purchasing today and you are reading this post on Facebook or Twitter, spend some money with the independent creative community today. Be it, buying a CD, poetry, a book, a painting, a dvd, photography, a scuplture or attending a live performance later tonight….spend some of that hard earned money with the indie creative community.

Now those of you in the indie creative community, should come up with sales incentives to make your product attractive for purchase during the holiday season. Give your fans and potential customers an incentive to spread money your way instead of solely with big box retailers and Conglomerate owned stores.

All of the above should also apply to Cyber Monday coming up in a couple of days.

Closing Comments:

Small and/or independent businesses are the backbone of this country and our greatest statement concerning what we support is evidenced by where we spend our money. Let’s make the effort to support independent business.

Personally, I have often found that the products and services I have obtained by doing business with independent businesses far exceeded the generic and impersonal products and services I have received from the big box retailers and conglomerate owned stores.

Warner Music May Be Favored to Win EMI’s Recorded Music

Murmurings in the industry say, “EMI Group’s catalog of recorded music may go to Warner Music Group after bidding $1.5 billion to $1.6 billion.”

“Warner Music and Citigroup Inc., which controls EMI, are negotiating expenses related to the London-based record company’s pension liabilities, said the people, who declined to be named because the talks are private.”

BMG Rights Management GmbH, the music company controlled by KKR & Co., is the front runner for EMI’s publishing business with a bid of $1.8 billion to $2 billion, one person said. Sony Corp. asked Citigroup for more time to raise money and recruit investors for a bid for the unit, which markets and licenses the rights of work by songwriters including Beyonce Knowles for use in films, ads and other performances, they said.

Citigroup may enter into exclusive discussions soon – perhaps this week if pension issues are resolved.

“The bank seized EMI in February after investor Guy Hands and his firm Terra Firma failed to meet loan covenants. At the time, Citigroup wrote down EMI’s debt 65 percent to 1.2 billion pounds ($1.9 billion). The bank has a target price of $4 billion for the sale of the entire company and $1.7 billion for recorded music, someone said.”

”Sony wants to add EMI publishing to its Sony/ATV Music Publishing venture with the estate of Michael Jackson. Sony has recruited Ari Emanuel, the William Morris Endeavor talent agency’s CEO, and Raine Group LLC, the media investment bank founded by Joe Ravitch, to join its bid, the people said. Mubadala Development Co., a sovereign fund of Abu Dhabi, is also an investor with Sony, the New York Post reported Oct. 21.”

Is Facebook, Spotify investor Sean Parker interested in EMI buy?

The Heretic’s Comment: When Spotify’s chief executive Daniel Ek came on stage to share the spotlight with Facebook CEO Mark Zuckerberg at the F8 conference last week in San Francisco, many believed that the man responsible for this nerd duet was Sean Parker, a thirtysomething Internet investor who has invested in both companies and is estimated by Forbes magazine to be worth more than $2 billion.

Now, Parker is trying to orchestrate another deal — acquiring EMI Music, according to Wayne Rosso, a music industry veteran and entrepreneur.

Parker, whose lavish party after the Facebook conference drew headlines and celebrities such as Eminem and Bruno Marks, is teaming up with grocery magnate Ron Burkle to put in a bid for EMI, which is being put up for sale by Citigroup, Rosso said on his blog, citing industry sources.

Is Parker about to crash the EMI party? An executive familiar with the bids told the Times that Parker is currently not involved in the auction.

Burkle, who made an unsuccessful run at buying Warner Music Group earlier this year, has been trying to drum up a partner to vie for EMI, according to a music industry executive.

Burkle is estimated to be worth $3.2 billion, according to Forbes magazine. While much of Parker’s wealth is tied up in Facebook stock, he has access to cash as a general partner of the San Francisco venture capital firm Founders Fund.

If Burkle succeeds in reeling in Parker, the two would need all the money they can muster, with potential buyers bidding between $3 billion to $3.5 billion for EMI. (Warner was sold for $3.3 billion in cash and debt.) Others lining up to buy EMI include Sony Corp., Universal Music Group, BMG Chrysalis and Warner Music Group.

Citigroup has informed bidders that it wants their best offers by next Wednesday, so theoretically, there is still time for a Burkle-Parker bid to gel.
