The Heretic’s Comment: Before sharing my observations concerning the 2012 Stellar Awards, I want to first say congratulations to all the winners and nominees. My comments following are not meant to be disrespectful toward the winners and nominees, but it is more directed to the powers that keep them propped up.

Now that the formalities are out of the way, on this past Saturday, I made up my mind that I was going to force myself to sit down and watch the entire Stellar Awards show no matter how tempted I was to change the channel. And that is what I did. I watched the entire show and even though I had clients that were nominated in certain categories it turned out to be a tortured experience for me.

The entire affair just seemed to be an overproduced, detached and unrealistic attempt to connect christian music to an audience. And I am not talking about the audience in attendance, because it appeared that the entire audience was on the payroll of the producers of the show to make it seem like every performance was full of God’s anointing and power.

The problem that I have with the Stellar Awards is that it comes off as one big propaganda tool to keep pushing the same small crop of christian entertainment royalty as the center of the christian musical universe. Keep in mind that the small group of christian musical artists I am referring to are for the most part owned and controlled by the Conglomerates. By the way, my complaints about the Stellar Awards, is essentially the same complaint I have about the Grammy’s as well, but I boycotted watching the Grammy’s this year.

At any rate, Christian Music is so much more dynamic, powerful and impactful, then the propaganda show we witnessed in this year’s Stellar Awards.

The only way to change the old guard protecting the same group of gospel and christian artist who keep being renominated and winning year after year after year is for you and I as listeners and lovers of gospel and christian music to support (truly) support the artist we love even if they don’t happen to be a house hold name.

Support Independent Music.

OFF D GRID is a movement we are still pushing. It essentially means developing your own alternate musical universe which is not reliant on Conglomerate operated and controlled distribution/supply chains. It advocates that you create and fight an insurgency campaign to connect your music to a paying fan-base in spite of the Conglomerates’ propaganda campaign to brainwash you into believing that your only route to achieve significant success and exposure is to sell out to them!!!

The Heretic’s Comments: Vinny Ribas of Indie Connect Magazine provides some excellent insight to why you might not have been successful as you want to be in selling your music online.

A direct link to the Vinny’s post appears directly below:

Closing Comments:

One of the most tragic mistakes I see recording artist constantly making is thinking that creating great music will cause people to discover them.

It is only partially true!!!

It is a given that you must record and deliver great music, but you also have to make great decisions in mapping out a plan which will allow the widest possible fan-base and customer-base to discover your music.

That being said, if YOU are not good with marketing and promoting YOURSELF these days, YOU will have a very short music career as well as not make any money.

Long gone are the days when you can just be a great songwriter, singer or musician and leave the responsibility of promoting yourself to a Record Label. YOU are YOUR own Record Label, and YOU better realize that YOU are going to have to get out their and kiss some babies and shake some hands if YOU are going to make impact.

YOU are in a business of relationships….if they don’t feel connected to YOU….YOUR music will be ignored…and they won’t spend money with YOU or YOUR products!!!

Take time to read Vinny’s post. It will help you organize your efforts in generating money online!!!

An example of Music CD Cost and Payout Breakdown

attorneycross On December - 10 - 20112 COMMENTS

The Heretic’s Comment:

According to Moses Avalon’s 1998 Book, Confessions of a Record
Producer, the proceeds of a then-$17 CD would typically be distributed
as follows:

Retailer: $5 (29.4%),
Record label: $4.92 (28.9%),
Distributor: $2.40 (14.1%),
Giveaways: $1.80 (10.6%),
Duplication/recording: $1.10 (5.8%),
Artist royalty: 83 cents (4.9%),
Songwriter license: 60 cents (3.5%),
Producer royalty: 27 cents (1.6%),
Musicians union: 8 cents (0.4%).

Now mind you, the numbers used in our example are from years ago, but it is instructive to show you just how greedy and abusive the Major Labels have been both to recording artists/producers/songwriters as well as to the general consumer.  The physical production cost of each CD might have cost the Major Label anywhere from 6 cents to 50 cents to manufacture, yet the Labels had the price jacked up in some cases as high as $19.98 for the retail price of the CD. Of this retail pricing, the combined money paid out to the recording artist, songwriter, producer and musician was  less than $2.00 per CD sold (in our example, it was actually $1.74 per CD sold).

The saddest part about the above is that despite using numbers from over 10 years ago, nothing presently has changed in the artist’s favor in reference to those signed under major recording contracts. In fact,  it is even worst now,  because of all of the 360 arrangements that Major Labels force artists to eat in exchange for getting a deal. So the possibility of an artist making money through record royalties in 2011 remains almost non-existent despite the fact that in this year Major Record Labels and their partners will pocket millions upon millions of dollars from physical CD sales.

Sadly enough the numbers on the digital side are even worst than the physical side, but we will deal with that in a separate post.

Closing Comments:

You have to have the courage to speak to Power and refuse to bow down. That is the only way these slave deals will ever change. As long as we are fighting and competing against each other to see who will have the next opportunity to be offered the major label deal, 10 years from now…nothing will have changed. Your musical sons and daughters will be signing the same slave deal you were forced to sign. Even more sadder than that is the fact that you will own none of your music…it will be under the firm control and ownership of a Conglomerate that has long forgotten about you.

Closing Comments:

Let me give you a definition of that famous Major Label “Fuzzy Math”:  when three full albums earn the artist $62.47 for five years worth of sales, but they still don’t get paid because they owe the Major Label $395,000.00. You can rest assured that this group will never make another dime from record sales despite the fact that the Major Label is probably making a profit on the catalog.

Let me give you one more definition: Recording Artist Slave Deals….you do all the work…you owe for everything that is spent…you own none of your master recordings….you make pennies on the dollar

Drake Addresses Album Leaks

attorneycross On November - 8 - 2011ADD COMMENTS

Drake Addresses Album Leaks

On Sunday night (Nov. 6), while Drake was in his hometown debuting a new song, “Crew Love,” from his upcoming sophomore album, “Take Care” (Nov. 15), on Toronto’s Flow 93.5, a leaked version of the project began circulating online. The version of the album that appeared featured 16 tracks — a few shy of the full collection said to be coming to retail. “I am not sure if the album leaked. But if it did thank God it doesn’t happen a month early anymore,” Drake tweeted just after 11pm EST. Minutes later, he posted a second tweet, saying, “Listen enjoy it, buy it if you like it… and take care until next time.”

“In early October, Drake spoke exclusively to Billboard about album leaks and their impact — almost predicting to the day when his album would leak online. So was last night’s leak a coincidence or all part of the “Take Care” plan?”

Austin City Limits 2011: 15 Things Seen & Heard Saturday

The Heretic’s Comment: hough Day 2 brought humidity and a veritable downpour to the Austin City Limits festival, a sold-out crowd didn’t seem to mind at all, donning ponchos and the sheets they brought as picnic blankets to shield themselves and listen on. Billboard was there for some of the best — and worst — moments of the day. Read onward for 14 highlights and things overheard at Zilker Park on Saturday, Sept. 17.

1. Headliner Stevie Wonder had a rough start last night, as a 20-minute delay and a poor sound system diluted the attention of the tens of thousands gathered to see the soul-pop king play his two-hour set. The further back in the crowd fans were, the more clearly they heard co-headliners My Morning Jacket, and many turned around to watch that set instead. Nevertheless, for fans within earshot of the PA system, the performance was nothing short of a damn good time. Wonder seemed to be having a riotously good time, at one point writhing on his back, keytar in hand, to hits like “Higher Ground” and “Signed, Sealed, Delivered, I’m Yours,” and “Sir Duke.”

No ACL set, it seems, would be complete without a little political soapboxing, and Wonder was no exception–he echoed Mavis Staples‘ sentiments from Day 1, indignantly shouting, “What’s with all this talking crap about Obama?” and calling for the tightening of gun ownership laws, while voicing confidence: “We can work it out!”

Thanks to Lil Wayne, Digital Albums Outsell Tracks for Only Second Time Ever

The Heretic’s Comment: With the help of Lil Wayne’s “Tha Carter IV,” digital albums topped digital track sales for only the second time in the digital era.

Put another way, last week the digital album represented more purchased music than digital tracks. Of course, tracks represented more unit sales – 2.28 million digital albums to 22.42 million tracks, according to Nielsen SoundScan. But when multiplied by 10 to account for the number of tracks on an album, digital albums beat out tracks 22.79 million to 22.42 million. (One could argue that a typical album has more than 10 tracks. But 10 tracks per album is the traditional measure used to calculate Track Equivalent Albums, and it is used here, too.)

Two big debuts helped digital albums reach the tipping point. “Tha Carter IV” sold 362,000 digital albums in its first week, representing 38% of its sales, according to Nielsen SoundScan. The Red Hot Chili Peppers‘ “I’m With You” also had a strong digital debut. Its 104,000 digital album sales represented 45% of its total sales.

It’s only the second time tracks from digital albums exceeded individually purchased digital tracks. The first was in late November 2010 after the Beatles’ catalog launched at iTunes. In the week ending November 21, 2010 digital albums accounted for 23.86 million tracks versus 22.2 million from individual tracks.

While major releases skew the ratio in favor of digital albums in any given week, last week’s strong showing by the digital album is actually part of a longer trend.  In fact, digital albums have represented a greater share of all digital music purchases over the years. Through September 4, digital albums accounted for 667 million tracks (again, calculated using 10 tracks per album) while 868.3 million digital tracks were sold – a ratio of 1.3-to-1

Black Eyed Peas’ Minot Benefit Concert Raises Over $1 Million

The Heretic’s Comment: Preliminary figures show a concert featuring The Black Eyed Peas as the headliner raised at least $1.3 million to help with flood recovery efforts in the North Dakota town of Minot.

Minot Area Community Foundation president Ken Kitzman said in a news release that Saturday night’s initial count of 15,800 people in attendance at the benefit concert breaks a previous record set for a KISS concert in 2010.

Kitzman said concert officials are still adding up donations, but at least $1.3 million has been raised so far.

Hollywood actor and Minot native Josh Duhamel spoke at the concert, which also featured Minneapolis-based rockers Charlz Newman. Duhamel is married to Black Eyed Peas singer Fergie.

LA Mayor Called on the City Legislature to pass a bill to extend California’s production tax credits beyond 2012

The Heretic’s Comment: Los Angeles Mayor Antonio Villaraigosa said he would consider additional steps to help the local movie and TV industry and make LA a competitive location for productions, including possibly reducing film permit fees and speeding up the permitting process, the LA Times reported.

He also called on the city legislature to pass a bill that would extend California’s production tax credits beyond 2012. A state Senate committee is expected to take up the bill Thursday, according to the Times.

Speaking to a group of producers, location managers and industry executives on Wednesday, the mayor cited previous steps to support the entertainment industry, such as free parking on city lots.

“We’re doing some things, and that’s nice and good, but we can do a whole lot more,” the Times cited Villaraigosa as saying. “This is one of the most important industries for us.” But he also cautioned that the city is constrained by a tight budget, saying: “There are limitations to what we can do.”

The entertainment industry in Los Angeles County directly employs about 140,000 people, according to the paper.
